CHALLENGES OF SHARIAH COURT IN MALAYSIA: AMEND SUITABLE AND RELEVANT ISLAMIC LAWS BASED ON SHARIAH PERSPECTIVE

This article highlights the challenges and application of Shariah Court in Malaysia which every year there have an issue regarding to this Islamic Law. As a Muslim applying the Islamic Law is a duty and obligation of every Muslim and cannot be separated at all. Any form of tyranny in any form is opposed and must be eliminated because Islam never tolerates cruelty. It is also aim at fending off some negative notions against the Shariah Court as the second-class court in terms of power and achievements in administering and implementing Islamic law in Malaysia. The study used qualitative approach and refers as well to secondary sources, which includes statutory provisions, articles, website information. It also explains about the existing provisions and suggest improvement of some aspects that are deemed important as the first step to prepare for the implementation of a more systematic alternative sentence in the Shariah Court. The results of the study can make the Shariah court a main guide for Muslims in matters of criminal offences, marriage, property and others. The impact is that the Shariah Court can provide proper justice to Muslims and make the Shariah Court an institution that is held in high esteem by all nations and not arbitrarily disregarded while the sharia law comes from Allah SWT and He is the best creator and knows what the best for man himself.
