Food allergies are one of the major risks posed to the safety of consumers and can lead to fatal anaphylactic shock. This paper discusses the case of Bhamra (suing as widow and administratrix of the estate of Bhamra, deceased) v Dubb (t/a Lucky Caterers) [2010] EWCA Civ 13, which revolves around the death of a guest who took a dessert that contained egg at a Sikh wedding reception, where food should have been in accordance with religious guidelines. The study provides a legal analysis of various aspects of duty of care, foreseeability, breach of duty of care, and causation in holding the food service providers liable. Further, it will look into the role of food forensic science in detection of allergens, verification of ingredients of food and their sources and finding out the causation by means of scientific methods like ELISA, PCR, and LC-MS/MS. Moreover, this paper highlights the use of various laws applicable in Malaysia in the scenario of a similar situation taking place there. The laws include Food Act 1983, Food Regulations 1985, Consumer Protection Act 1999, Contracts Act 1950, Trade Descriptions Act 2011, and the law of negligence. The research has proven that allergen control, ingredient labeling, food traceability, and food safety are critical components that must be fulfilled to ensure public safety and reduce the risk of liability.
