THE USING OF PRE-EXPOSURE PROPHYLAXIS (PrEP) AMONG HIGH-RISK SEXUAL OFFENDERS (LGBTQ) ACCORDING TO THE SHARIAH PERSPECTIVE IN MALAYSIA: CONSIDERATION BETWEEN MASLAHAH AND MAFSADAH

The phenomenon of LGBTQ (Lesbian, Gay, Bisexual, Transgender, and Queer) among Malaysians is growing. These groups often claim they are discriminated against and demand equality and fundamental rights. Islam also guarantees that human rights are granted to those entitled based on the guidelines set by the Sharia. Nevertheless, the effects of the perverted culture brought by them have invited danger to Malaysians and caused the spread of HIV infection to increase every year. Scientific studies prove the effectiveness of PrEP treatment in reducing HIV infection. The initiative program of giving PrEP medication for free to LGBTQ people at health premises should be evaluated based on maslahah and mafsadah in Islam. This study aims to identify the extent to which PrEP is suitable for this group based on the maslahah and mafsadah in Malaysia. Throughout the study, the researcher used research methods, which are data collection methods implemented through library research, to obtain relevant data. The study shows that the Initiative Program of providing PrEP for free needs to be reviewed and discussed again according to the considerations of maslahah and mafsadah so as not to lead to more significant harm to Malaysians.
