THE IMPLEMENTATION OF RECIPROCAL ORDERS IN THE SYARIAH COURTS OF THE FEDERAL TERRITORIES: A PRELIMINARY REVIEW

Reciprocal orders constitute an important mechanism in strengthening the effectiveness of enforcing Syariah Court decisions across the states in Malaysia. Although this concept is provided for under the administrative laws governing the Syariah Courts, its implementation continues to face various challenges, particularly in terms of procedural aspects, the level of understanding among the relevant authorities, and the lack of uniformity in administrative facilities. This article aims to provide a preliminary examination of the implementation of reciprocal orders through the existing legal framework and current practices that may serve as guidance, thereby drawing attention to the need for improvement. The study offers an initial overview that may serve as a basis for further discussion in academic seminars and research platforms related to the Syariah judiciary in Malaysia.

Abstrak

Perintah bersaling merupakan satu mekanisme penting dalam mengukuhkan keberkesanan penguatkuasaan keputusan Mahkamah Syariah antara negeri-negeri di Malaysia. Walaupun konsep ini telah diperuntukkan dalam undang-undang pentadbiran Mahkamah Syariah, pelaksanaannya masih berdepan pelbagai cabaran, khususnya dari sudut prosedur, tahap kefahaman pihak berautoriti serta kemudahan pentadbiran yang tidak seragam. Artikel ini bertujuan untuk meninjau pelaksanaan perintah bersaling secara asas melalui kerangka perundangan sedia ada dan amalan semasa yang boleh dijadikan panduan, seterusnya menuntut perhatian ke arah usaha penambahbaikan. Kajian ini memberikan gambaran awal yang boleh dijadikan asas perbincangan lanjut dalam seminar akademik serta platform penyelidikan berkaitan bidang kehakiman Syariah di Malaysia.
