THE PRINCIPLE OF SIN AND AGGRESSION AND ITS IMPACT ON MUSLIMS' UNDERSTANDING OF EMERGING ISSUES: A STUDY OF CONTEMPORARY FATWAS

This research aims to elucidate the principle of cooperation in sin and aggression and its impact on governing fatwas regarding contemporary emerging issues (Nawazil). It is based on Sharia evidences, primarily the verse: “And cooperate in righteousness and piety, but do not cooperate in sin and aggression” (Al-Ma'idah: 2). The researcher employed a descriptive-analytical methodology to survey authentic texts from the Quran and Sunnah, and to analyze fatwas issued by various fatwa bodies (the Assembly of Muslim Jurists of America [AMJA], the Permanent Committee, and the Palestinian and Jordanian Fatwa Houses) concerning contemporary social and economic issues. The study revealed that this principle governs the fatwas that clarify Sharia rulings for these modern developments and corrects the trajectory of Muslims' interaction with them. The study recommends enhancing and expanding research into the impact of this principle and other universal Quranic principles, highlighting their significance in regulating fatwas and rationalizing conduct in the rapidly evolving fields of digital and financial emerging issues.

يهدف هذا البحث إلى بيان مبدأ التعاون على الإثم والعدوان وأثره في ضبط فتاوى النوازل المعاصرة، مستندًا إلى أدلة شرعية أهمّها قوله تعالى: (وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَىٰ ۖ وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ) (المائدة: 2). استخدم الباحث المنهج الوصفي التحليلي لاستقراء النصوص الأصيلة من القرآن والسنة، وتحليل فتاوى هيئات الإفتاء في دول متعددة (مجمع فقهاء الشريعة بأمريكا، اللجنة الدائمة، دار الإفتاء الفلسطينية والأردنية) في قضايا اجتماعية واقتصادية معاصرة. أظهرت الدراسة أن المبدأ يضبط الفتاوى التي تبيّن الحكم الشرعي لهذه المستجدات، ويصحح مسار تعامل المسلمين معها. وتوصي الدراسة بتعزيز البحث وتوسيعه في أثر هذا المبدأ وغيره من المبادئ القرآنية الكلية، وإبراز أهميتها في ضبط الفتوى وترشيد التعامل في مجالات النوازل الرقمية والمالية المتتالية.
