KEKUATAN HUKUM ISTERI DAN ANAK DALAM KARTU KELUARGA NIKAH SIRI

Abstract

This article explains the position of the wife and the child as written on the family card of the siri married couples. This theme was written because of the Regulation of the Minister of Home Affairs No. 09 of 2016 regarding the Acceleration of Increasing the Coverage of Birth Certificate Ownership became the basis for siri married couples to have a family card although they do not have a marriage book or marriage certificate. In lieu of the requirement for a marriage book or marriage certificate is a Statement of Absolute Responsibility (SPTJM). Up to this point, there is a conflict appearing with Law No. 1 of 1974 regarding Marriage or the Compilation of Islamic Law. With the documentation method and the approach to the regulations, several points can be explained as below. First, siri married couples can have a family card using the Statement of Absolute Responsibility mechanism, however, there are some differences in the types of family card as the ordinary one. Namely, the family card for siri married couples contains the statement 'Unregistered marriage'. Second, the position of the wife and the child on the family card of the siri marriage couples, although it is valid according to the Sharia, but from the perspective of the laws and regulations in Indonesia, it does not have the force of law.

Abstrak

Artikel ini menjelaskan kedudukan Isteri dan Anak yang dituliskan dalam kartu keluarga pasangan nikah siri. Tema ini ditulis karena Peraturan Menteri Dalam Negeri Nomor 09 Tahun 2016 tentang Percepatan Peningkatan Cakupan Kepemilikan Akta Kelahiran, menjadi dasar pasangan nikah siri dapat memiliki kartu keluarga meskipun mereka tidak memiliki buku nikah atau akta perkawinan. Sebagai ganti syarat buku nikah atau akta perkawinan adalah Surat Pernyataan Tanggung Jawab Mutlak (SPTJM). Sampai di sini nampak pertentangan dengan Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan maupun Kompilasi Hukum Islam. Dengan metode dokumentasi dan pendekatan peraturan perundang-undangan dapat dijelaskan beberapa point. Pertama. Meski pasangan nikah siri dapat memiliki kartu keluarga dengan menggunakan mekanisme SPTJM, namun demikian ada terdapat perbedaan jenis kartu keluarga sebagaimana lazimnya. Yaitu kartu keluarga bagi pasangan nikah siri terdapat keterangan ‘Kawin Belum Tecatat’. Kedua. Kedudukan Isteri dan Anak dalam Kartu keluarga pasangan nikah siri, meski secara syariat telah sah namun dari sisi peraturan perundang-undangan di Indonesia tidak memiliki kekuatan hukum.
