KONTRIBUSI TRILOGI NALAR MUHAMMAD ABED AL JABIRI DALAM KONTEKS PENGEMBANGAN EPISTEMOLOGI HUKUM ISLAM DI INDONESIA

Abstract

Fiqh, is actually the result of a dialectic between authoritative texts (the Qur'an and to a certain extent al-Hadith) and human reality, a dialectic between revelation and reason, a dialectic between the heavenly and land intelligently read by the children of his time. As the main references of fiqh, the Qur'an and Hadith certainly need to be interpreted in a comprehensive and integrative manner, through a contextual approach and epistemology. Whether we realize it or not, the fiqh that we consume does not range far from medieval packaged fiqh, where most of the fiqh products were created by male scholars. So, it is very logical and necessary if these classical fiqh thoughts are placed in a general configuration and context when these fiqh thoughts are produced on the one hand and in a particular epistemological context on the other. Mohammad Abed al Jabiri, is one of the Islamic thinkers who seriously examines Arabic with all related matters, culture, rationality, and Arabic reasoning formed through three aspects, bayani, burhani and irfani, and their implications for Islamic law.

Fiqh, sesungguhnya adalah hasil dialektika antara teks-teks otoritatif (Al- Qur'an dan dalam kadar tertentu juga Al-Hadits) dan realitas kemanusiaan, dialektika antara wahyu dan akal, dialektika antara yang samawi dan ardhi yang dibaca secara cerdas oleh anak-anak zamannya. Sebagai rujukan utama fiqh, Al-Qur’an dan Hadits tentu perlu di maknai secara komprehensif dan integratif, melalui pendekatan dan epistemologi yang kontekstual. Disadari atau tidak, fiqih yang kita konsumsi tidak berkisar jauh dari fiqih kemasan abad pertengahan yang kebanyakan produk fiqihnya dikreasikan oleh para ulama laki-laki. Jadi sangat logis dan niscaya jika pemikiran fiqih klasik tersebut diletakkan dalam konfigurasi dan konteks umum saat pemikiran fiqih tersebut diproduksi disatu sisi dan dalam konteks epistemologinya tertentu disisi lain.
